Please read these Terms of Service ("Terms") carefully before using the PebblePals website and services ("Site", "we", "us", or "PebblePals"). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to form a binding contract to use our Site. By using the Site you represent and warrant that you meet this requirement.
2. Account, Registration and Security
Some Site features may require creating an account. You agree to provide accurate, current, and complete information and to maintain and promptly update your account information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
3. Orders and Purchases
All orders are subject to acceptance and availability. We may refuse or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or product information, or suspected fraud. Prices and availability are subject to change without notice. Payment is due at the time of purchase. We accept the payment methods displayed at checkout.
4. Product Information and Pricing
We attempt to be as accurate as possible in product descriptions, images, sizing, colors, and pricing. However, we do not warrant that product descriptions or other content are accurate, complete, reliable, current, or error-free. In the event of a pricing error, we reserve the right to cancel orders or charge the correct price.
5. Shipping, Returns and Refunds
Shipping, returns, refunds, exchanges, and cancellations are governed by our separate Shipping Policy and Return & Refund Policy posted on the Site. By placing an order you agree to those policies.
6. Intellectual Property
All content on the Site—including text, graphics, logos, images, audio, video, and software—is owned or licensed by PebblePals and protected by copyright, trademark, and other laws. You may view and print materials for personal, noncommercial use only. You may not copy, reproduce, modify, distribute, create derivative works from, publicly display, or commercially exploit Site content without our prior written consent.
7. User Content
If you submit reviews, photos, comments, or other content ("User Content"), you grant PebblePals a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. You represent and warrant that you own or have the rights to submit User Content and that it does not violate third-party rights or applicable law.
8. Prohibited Conduct
You agree not to: use the Site for unlawful purposes; infringe others’ intellectual property or privacy rights; post harmful, defamatory, obscene, or abusive content; interfere with Site operation; attempt to gain unauthorized access to the Site, accounts, or systems.
9. Third-Party Links & Services
The Site may contain links to third-party websites or services that we do not control. We are not responsible for their content, policies, or practices. Any dealings with third parties are solely between you and that third party.
10. Disclaimers
The Site and all products and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the fullest extent permitted by law, PebblePals and its officers, directors, employees, agents, suppliers and affiliates are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or loss of profits, revenue, data, or use, arising from or related to your access to or use of the Site or products purchased through the Site. Our aggregate liability for direct damages will not exceed the amount paid by you for the relevant order.
12. Indemnification
You agree to indemnify, defend and hold harmless PebblePals and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, breach of these Terms, or violation of any law or the rights of a third party.
13. Termination
We may suspend or terminate your access to the Site, in whole or in part, at any time and for any reason, with or without notice. Sections that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the state or jurisdiction where PebblePals is headquartered, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved in the courts located in that jurisdiction, and you consent to the exclusive jurisdiction and venue of those courts.
15. Changes to Terms
We may revise these Terms at any time. The "Effective date" at the top will reflect the date of the latest version. Continued use of the Site after changes constitutes acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary and the remaining provisions will remain in full force and effect.
